Terms of Service
These Terms govern your access to and use of ELD HOS Compliance websites, APIs, admin tools, and the mobile driver application. By creating an account, signing in, or using our services, you agree to these Terms.

1. Agreement
This agreement is between you (the individual driver, carrier, fleet operator, or authorized administrator) and ELD HOS Compliance ("we", "us", or "our"). If you use the services on behalf of a company, you represent that you have authority to bind that company to these Terms.
2. The service
ELD HOS Compliance provides electronic logging device (ELD) and hours-of-service (HOS) related software, including driver mobile apps, fleet administration tools, telemetry ingestion, reporting, and related support features. Features may change as we improve the platform.
You remain solely responsible for complying with applicable FMCSA, DOT, and other transportation regulations. Our software is a compliance aid; it does not replace your legal obligations as a motor carrier or driver.
3. Accounts and access
You must provide accurate account information and keep credentials confidential. You are responsible for activity under your account. Notify us promptly of unauthorized use. Carriers must ensure only authorized personnel access fleet data and that drivers use the app in accordance with company policy and law.
4. Acceptable use
You agree not to:
- Falsify, tamper with, or intentionally misrepresent duty status, location, or vehicle data
- Attempt to bypass security, reverse engineer, or disrupt the service
- Use the service for unlawful purposes or in violation of ELD/HOS rules
- Share accounts in a way that defeats audit or attribution requirements
- Upload malware or abuse APIs beyond documented rate and access limits
5. Driver and carrier responsibilities
Drivers must review and certify logs as required by regulation and carrier policy. Carriers are responsible for device installation practices, driver training, record retention, and responding to roadside inspections. Edited or annotated logs must retain required explanations where the law demands them.
6. Subscriptions and payment
Paid plans, if applicable, are billed according to the pricing shown at purchase or in your order form. Fees are non-refundable except where required by law or expressly stated in writing. We may suspend access for unpaid invoices after reasonable notice.
7. Intellectual property
We and our licensors own the software, branding, documentation, and related IP. You receive a limited, non-exclusive, non-transferable right to use the service during your subscription. You retain ownership of your operational data; you grant us a license to host, process, and display that data as needed to provide the service.
8. Third-party services
The service may integrate with maps, payments, messaging, or cloud providers. Their terms and privacy practices apply to their portions of the experience. We are not responsible for third-party outages outside our reasonable control.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted operation, error-free results, or that use of the service guarantees regulatory compliance.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELD HOS Compliance AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
11. Indemnification
You will indemnify and hold us harmless from claims arising from your misuse of the service, violation of these Terms, or violation of applicable law, including ELD/HOS requirements, except to the extent caused by our willful misconduct.
12. Suspension and termination
We may suspend or terminate access if you breach these Terms, create security or compliance risk, or fail to pay fees. You may stop using the service at any time. Upon termination, your right to access ends; we may retain records as required by law or our Privacy Policy.
13. Changes
We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after the effective date constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws applicable to the place where ELD HOS Compliance primarily operates its services, without regard to conflict-of-law rules, except where mandatory consumer or transportation laws require otherwise.
